Is it possible to sue McDonalds?

Myself, my 2 year old son and my God daughter were given salmonella poisoning by McDonalds this week. We have been referred to microbiology by the doctors for tests etc. Would it be worth it to expose how filthy this company are?

Are you in the UK or America? If in UK, yes you can. If you get a medical report showing food poisoning, it's highly unlikely that McDonald's would bother fighting you. They would in all probability admit liability and settle your case. For your two year old daughter, the court must by law approve any settlement to make sure McDonald's have offered enough. Just because they are a large company, don't make the mistake of thinking they are too large and that it would be too expensive to pursue a claim. No offence but they would consider you small fry (no pun intended!) and would not waste expensive legal resources on you for such a small matter if there is clear proof that you had food poisoning. You would need a medical report which clearly shows food poisoning though.

It's possible to sue anybody - it's just not possible to say whether you can win. In any case you need the case to be based on undisputable recorded fact and this would need to be established with the public health authority in which the resturant was located. In any case the suit would probally be against the holder of the franchise ( not McDonalds directly )

Go for it. My mate took a video about 2 weeks ago of rats climbing up into the skip outside our local Macdonalds, and done nothing. He bought his meal, (yes he still ate there) then just left. I couldnt believe it. If you're sure thats what made you all ill, sue the pants off the stinking hole

If you have some evidence directly linking them to your illness, you could approach a solicitor to make an out of court offer, before suing them in court. You are perfectly within your rights to do this, and to any place that has given you food poiosoning - they have a legal responsibility to ensure food hygiene standards are maintained. I hope you all feel better soon.

You probably could but i dont know if you would want to because todays government is weird. You spend a lot of money going to court and paying for the fees. But i guess you can ask for that money.

Yes, you should sue them! besides you'd think that companies as big as those would want to keep customers happy...not poisoned. My grandma once ordered a burger with no cheese because she's allergic; she told them that if she ate cheese she could go to the hospital and sue them.



Poisoning is way more terrible, I think you ought to tell them or if your son continues to vomit make them pay, people get al lot of money in these cases.

It would be hard to suit the entire chain of mcdonalds. To make suit against that particular store, that branch, yes, of course. But the entire chain of mcdonalds is not at fault for what happened at one branch. Find out about the administration at that branch. Find an attorney who will be willing to bring suit against that branch of mcdonalds. Good luck.

Of course its possible to sue, remember the woman who sued over spilled coffee.

It would take lots of money and lots of time, but its possible.

A more logical approach is to call the Health Dept. and file a complaint, with proof, to them.

You might check with a lawyer. You might find one who will take the case pro bono (free, with a percentage if you win). A few years ago, a woman successfully sued McDonald's over hot coffee spilled in her lap.

Take it to the papers that should do it, maybe then you might get some compensation settlement out of court.

Yes, I'm pretty sure you have to go through the small claims court though. Go to a citizen's advice bureau near you and they'll help you along..

No you cant. Imagine the amount of people who would do that. I got food poisoning from McDonalds and have not eaten it since.

Absolutely, but don't forget they can afford the best lawyers, so make sure your case is watertight. You might be able to get one of those no win -no fee lawyers to act for you.

yes, sue them. if you can prove it was from them you will be laughing all the way to the bank. they will pay you loads to keep it quiet. take their money and squeal to the papers anyway.
